1. Introduction and Acceptance of Terms

Welcome to Excellent Finserv Private Limited ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website (www.excellentfinserv.com), and related digital financial services (collectively, the "Platform").

By downloading, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Platform.

2. Eligibility

To use our Platform, you must be:

• At least 18 years of age.
• A resident of India.
• Capable of entering into a legally binding contract under the Indian Contract Act, 1872.

3. Account Registration and KYC Compliance

• Accurate Information: You must provide accurate, current, and complete information during registration.
• KYC Verification: To access certain financial features (like wallet transfers, bank payouts, and digital gold), you must complete the Know Your Customer (KYC) process by submitting valid government-issued ID proof (e.g., PAN Card, Aadhaar Card).
• Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and OTPs. The Company will not be liable for any unauthorized access to your account.

4. Description of Services

The Platform offers various digital services, including but not limited to:

• Utility Payments & Recharges: Facilitating mobile recharges, DTH, and utility bill payments via third-party aggregators (e.g., BBPS).
• Digital Wallet & Payments: Storing funds for quick transactions within the app ecosystem.
• Digital Gold: Buying, selling, and setting up SIPs for digital gold, facilitated through our registered third-party partners (e.g., Augmont).
• Referral & Reward Programs: A structured network/business program where users can earn commissions based on successful referrals and network/business.

5. Subscription & Membership Fees

• Activation Fee: The one-time subscription or membership fee is charged to activate premium features and provide prioritized service.
• Refund Policy: All subscription fees paid to Excellent Finserv are strictly non-refundable once the service is activated on the user's dashboard.

6. Referral & Sponsor Commission Policy

• No Guaranteed Income: The referral and business programs are promotional reward structures. We do not guarantee any fixed income, salary, or financial return simply by joining the network.
• Valid Transactions: Commissions are generated strictly based on actual, successful transactions made by your referred network (downline).
• Modification Rights: Excellent Finserv Private Limited reserves the absolute right to modify, restructure (e.g., changing business levels incentive percentages), or terminate the referral program at any time without prior notice.

7. Payments, Wallet, and Fees

• Transaction Limits: The Company reserves the right to impose limits on the number and amount of transactions processed through the wallet.
• Failed Transactions: In case of failed transactions where money is deducted from your bank but not credited to the service provider, refunds will be processed as per banking guidelines (usually within 5-7 working days).
• Convenience Fees: We may charge a nominal convenience fee on certain transactions. Any applicable fees will be displayed to you before completing the transaction.

8. Specific Disclaimers for Platform Use

• General Participation: DISCLAIMER: Participation is entirely voluntary. By joining, the user acknowledges that they have read the terms and conditions and agrees that the organizers are not liable for individual technical errors or data entry mistakes.
• Accuracy of Information: DISCLAIMER: All information provided herein is for informational purposes only. While we strive for accuracy, we do not guarantee that the sign-up interface will be error-free or accessible at all times.
• Technical Issues: DISCLAIMER: We are not responsible for the functionality or performance of any external browsers or third-party sign-up platforms used during the registration process.
• Camera Access: DISCLAIMER: Camera access is used solely for profile verification and document uploads. The organizers are not responsible for any content captured or shared by the user accidentally.
• Contacts Access: DISCLAIMER: Contact access is requested to invite friends and verify identity. Users provide this access voluntarily, and the organizers are not liable for any third-party communication resulting from this sync.
• Location Access: DISCLAIMER: Location (precise and approximate) is accessed strictly to prevent fraud and comply with regulatory security guidelines.
• Microphone Access: DISCLAIMER: Microphone access is required for specific features like voice commands or verification calls. We do not record or store audio without active user engagement.

9. User Conduct and Prohibited Activities

Users are strictly prohibited from engaging in the following activities:

• Users shall not use the app for any fraudulent, illegal, or unauthorized purposes, including money laundering or terrorism financing.
• Any attempt to reverse-engineer the app, bypass security protocols, or use automated scripts/bots will result in immediate termination of the account and will be reported to the relevant authorities.

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if we suspect a violation of these Terms, fraudulent activity, submission of fake KYC documents, or any action that harms the Company's reputation.

11. Limitation of Liability

To the maximum extent permitted by law, Excellent Finserv Private Limited shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the platform, including but not limited to loss of profits, data, or funds.

12. Governing Law and Dispute Resolution

• Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India.
• Disputes: Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Ghaziabad, Uttar Pradesh.
